Georgia Child Custody Notes

Before you can be granted a divorce, the custody of all children must be resolved.

The child's best interest is the primary concern when deciding on custody.

Visitation is usually granted to the parent not given custody.

Judges also consider which parent will best help the child maintain a healthy relationship with the non-custodial parent.

A child over the age of 14 can choose which parent to live with, unless specific findings are made that the chosen parent is unfit.

 

Q: What is a Guardian Ad Litem?
A: A Guardian Ad Litem is usually an attorney appointed by the Court to represent the child in a legal dispute concerning their custody or welfare. The guardian is empowered to investigate the backgrounds, living conditions, family relationships, and any other related matter in order to make a recommendation to the court as to what would be in the best interests of the child as to placement, visitation, and other matters.

Many people wonder why any court would think that the parties (usually parents of the child) would not have the concerns of the child in mind. However, in many cases, the parties to the case are so wrapped up in their own problems or needs that they fail to see the situation from the perspective of the child. The court appoints the guardian so that he/she does not owe any allegiance to either party.
